Happy Turtle LLC respects the intellectual property rights of others and expects our users and vendors to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to valid notices of alleged copyright infringement.
Reporting Infringement
If you believe content on the marketplace infringes your copyright, please send a written notice to our designated agent at support@happyturtle.com with the subject line “DMCA Notice.” Your notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the infringing material and enough information for us to locate it (such as the product URL).
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Counter-Notification
If you believe your material was removed by mistake or misidentification, you may send a counter-notification to the same address. It must include your signature, identification of the removed material and its previous location, a statement under penalty of perjury that you have a good-faith belief the material was removed in error, your contact information, and your consent to the jurisdiction of the federal court in your district (or, if outside the United States, the district where Happy Turtle is located).
Repeat Infringers
We will, in appropriate circumstances, disable or terminate the accounts of users or vendors who are found to be repeat infringers.
